Non-maleficence and the law: Constitution and statute law: Scenario
For religious reasons the parents of a one year old child refuse to allow the child to have a blood transfusion. The hospital does not have access to artificial plasma or any other blood substitute that can be used. The parents argue that if they consent to their child receiving a blood transfusion, the child’s soul will be forever damned.
What is the ethical and legal approach that the hospital doctors should take in these circumstances?
